TV1 CASH TRIVIA CHALLENGE 2008 - JULY

(Game of Chance)
Competition Overview: The TV1 Cash Trivia Challenge 1 July – 31 July 2008 is a game of chance comprising a series of 31 different Trivia Games held over 31 consecutive days commencing on 1 July 2008 and ending on 31 July 2008. Each Trivia Game is transmitted 3 times on each day on TV1 (with a re-transmission of the same three Trivia Games on TV1 plus 2, later on the same day). A different Game Code will be transmitted with each different Trivia Game transmission on TV1 (a total of 93 different Game Codes). The re-transmissions on TV1 plus 2, will use the same 93 Game Codes.
No pre-registration is required to enter the Competition. Entry, however, is open only to persons who are Foxtel / Austar, or Optus subscribers.
Entries may be submitted by Premium Rate SMS. Each entry must include one of the 93 Game Codes and be received by 11.59pm AEST 31/07/08.
Entries are NOT to include any answers to the questions asked in any Trivia Game. The questions are for viewer enjoyment only and are not relevant to entry into the Competition. (What is relevant is the published Game Code).
There is a limit of one entry per subscriber for each Game Code. The maximum number of entries that a subscriber may submit is 93 (equal to the number of different Game Codes that will be issued).
The last Trivia Game will be transmitted on 31 July 2008. The prize draw will be held on Monday, 4 August 2008 from all entries received, and one entrant will win the major prize of $20,000 cash (awarded as a cheque).
Conditions of Entry
1. The TV1 Cash Trivia Challenge, 1 July 2008 – 31 July 2008 (the “Competition “) is a game of chance comprising a series of 31 different Trivia Games held over 31 consecutive days commencing on 1 July 2008 and ending on 31 July 2008. Each Trivia Game will be transmitted 3 times on each day on TV1 (with a re-transmission of the same three Trivia Games on TV1 plus 2, later on the same day). On each of the 93 occasions that a Trivia Game is transmitted on TV1, a unique code number (a “Game Code”) will be provided (a total of 93 different Game Codes). The re-transmissions on TV1 plus 2, will use the same 93 Game Codes.
2. Entry is open only to “Eligible Entrants”. An “Eligible Entrant” (i) is a current subscriber to a service offered by a subscription television provider licensed to carry TV1 (a “Subscriber”) and who (ii) is not (a) an employee of, or contractor to, the Promoter or any of its related companies, or the Promoter’s distributors, external auditors and platforms including The Shooting Star Picture Company, belong Pty Ltd and their associated agencies and any other agencies or companies associated or connected with the Cash Trivia Challenge, or (b) a member of the immediate family of any such employee or contractor. "Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they live in the same household as the employee/contractor.
3. Entry commences at AEST 00:01am on 1 July 2008 and closes at 11.59pm AEST on 31 July 2008.
4. In each Trivia Game, questions with multiple-choice answers, are asked in succession. An entrant is not required to submit the answers to those questions as part of their entry. The questions are asked for viewer enjoyment only and neither the questions, nor the answers, are relevant to enter into the Competition.
5. An entry may be submitted by SMS. The cost of submitting one entry by sending an SMS message, is 55c including GST.
6. An Eligible Entrant may submit only ONE entry for each different Game Code (a maximum of 93 entries per Eligible Entrant). If an Eligible Entrant submits more than ONE entry with the same Game Code, all the Eligible Entrant’s entries are invalid. Each Game Code is only valid until midnight each night.
7. Each SMS entry must be sent as a single SMS message to 199 99 881 and must include the Game Code for the entry that is being submitted. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.
8. Entries must be received by 23:59 (AEST) on Thursday 31 July 2008 (within each Game Code eligibility period). The time of the entry will in each case be the time the SMS message is received by the belong Pty Ltd database. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.
9. The prize draw will take place at 2pm AEST on 4 August 2008 at belong Pty Ltd, Level 8, 155 George Street, Sydney NSW 2000.
10. The Eligible Entrant whose valid entry is first drawn will win the prize made out in favour of the Eligible Entrant. The prize is non transferable.
11. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
12. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
13. If the Winner is under the age of 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.
14. The Promoter’s decisions are final and no correspondence will be entered into.
15. The winner will be notified by phone within 2 days of the draw (where possible), in writing and their details will be published in the public notices section of The Australian on 11 August 2008 and on the TV1 website at www.tv1.com.au from 6 August 2008.
16. Subject, where relevant, to any directions given under the legislation regulating this promotion, if the prize is unclaimed, it will be awarded in a further draw to be held at 10am AEST on 1 December 2008 at belong Pty Ltd, Level 8, 155 George Street, Sydney NSW 2000 and the name of the winner in this draw will be published in The Australian on 8 December 2008.
17. If, for any reason, any part of the Competition is not capable of running as planned, including war, terrorism, state of emergency or disaster, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of any part of this Competition, the Promoter reserves the right (A) in its sole discretion to disqualify any individual who tampers with the entry process, or may benefit from such tampering, and (B) subject to the approval of those authorities which have issued permits for the conduct of the Competition, to cancel, terminate, modify or suspend any or all of parts of the Competition.
18. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failures, theft or destruction or unauthorized access to, or alteration of entries. The Promoter is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any SMS communication or web entry to be received by the Promoter or an entrant because of technical problems or traffic congestion on the carrier network, internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer or telephone related to or resulting from participation or downloading of materials in this promotion.
Caution: any attempt to deliberately damage or interfere with the normal receipt of SMS messages, or to otherwise undermine the legitimate operation of this competition may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the promoter reserves the right to seek damages to the fullest extent permitted by law
19. Entrant personal information ("PI") will be collected to enable the Promoter to administer and promote this Competition and its winner. The PI of the winner may be provided to others assisting, including the prize deliverer, and to authorities that regulate this Competition. Entrants may contact the Promoter at the address given below to request access to any of their collected PI that is still held. If an entrant does not truthfully provide all requested PI, the Promoter may determine that they are not eligible to win the prize.
